Biography

Mark C. Scarsi is an American lawyer specializing in patent litigation. From his previous career as a software engineer, he has a strong background in computer software and related technology.

Scarsi is currently a partner in the Litigation & Arbitration Group of Milbank, Tweed, Hadley & McCloy and head of its Intellectual Property Litigation & Technology practice. Scarsi is also Co-Managing Partner of the firm's Los Angeles office.

Education and early career

Scarsi received a B.S. and M.S. in computer science at Syracuse University. He spent the next decade working as a software engineer on U.S. Navy defense projects. According to Scarsi, this technical knowledge has helped him throughout his legal career by giving him the ability to explain complicated technology to jurors in a way they can understand.

In 1996, Scarsi earned his law degree from Georgetown University. He then joined the Los Angeles office of law firm O'Melveny & Myers, where he defended patent-infringement cases and became partner.

Milbank, Tweed, Hadley & McCloy

In 2007, Scarsi joined Milbank, Tweed, Hadley & McCloy to establish and lead the firm's West Coast intellectual property practice. He is currently a partner in the firm's Litigation & Arbitration Group as well as the head of its Intellectual Property Litigation & Technology practice. Scarsi is also Co-Managing Partner of the Los Angeles office.

Scarsi has represented such clients as Apple Inc., Lockheed Martin, and Google in intellectual property cases. Scarsi headed the Milbank trial team which secured a favorable verdict for client Apple in NetAirus Technologies LLC v. Apple Inc. The Los Angeles Daily Journal selected the case as one of its "Top Verdicts of 2013." The following year, in Wi-Lan Inc. et al. v. Apple Inc., Scarsi again led a Milbank trial team in securing a favorable verdict for client Apple. The summary judgment for Apple avoided a trial which could have cost the company more than $70 million. The Los Angeles Daily Journal selected the case as one of its "Top Verdicts of 2014." In 2013, AmLaw Litigation Daily named Scarsi "Litigator of the Week" for his leading role in securing a major victory for Apple over Wi-Lan in an intellectual property trial in the U.S. District Court for the Eastern District of Texas.

In 2013, 2014, and 2015, The Los Angeles Daily Journal selected Scarsi as one of California's "Top 75 IP Litigators."
