Biography

Justice Nagendra Kumar Jain is a multifaceted personality, an eminent judicial stature renowned as convener of legal literacy, Human Rights and its awareness programs ever since he became the Chairman of Bar Council of Rajasthan. He was also been invited to discuss the reforms in the judiciary by Parliamentary Estimate committee in the year 1985~86. While becoming Member Bar council of India and Member of Executive and governing council of National Law School of India University in 1986 further strengthened his vision of working in the field of legal literacy and awareness. His true sportsmanship spirit is clearly reflected throughout his career as he is also known for setting up several milestones by disposing record number of court cases during his administration by technically upgrading the traditional infrastructure. He is also known for his efforts to propagate Article-51(A) of the Constitution of INDIA and motivate everyone to discharge his duties as "Rights & Duties are correlated".

Early life

He was born on 20 October 1942 in Alwar Rajasthan and completed his primary education from Happy School. Later He shifted to Jaipur for his higher education and completed his secondary education from Mahaveer School. Further continued his education from Maharaja College, Jaipur and graduated from Rajasthan College of Rajasthan University. He also represented sate in several National and inter state Badminton tournaments from 1955 to 1968 and in 1977 he also played Nationals in veterans.

Career

After receiving his degree of The Bachelor of Laws (LLB) from Jodhpur University in 1967 He got enrolled as an advocate on 26 January 1968 in Rajasthan High Court and started his practice with emphasis on Civil, Criminal, Constitutional, Writ, Company and Taxation Matters. He also worked as a part-time Lecturer in Jodhpur University and served on the following positions before being appointed as Judge of Rajasthan High court.

Judicial career

He started his judicial journey as a Judge of Rajasthan High Court on 20 July 1990. He spent around 6 years at Jodhpur and about 16 months at Jaipur bench as a Judge. He was transferred to Madras High Court on 18 November 1997. He officiated as Chief Justice on 22 January 1999 till May 1999, 28 September to 9 October 1999 then 6 June till become permanent Chief Justice in Madras High Court on 13 September 2000. There after he was transferred as Chief Justice of Karnataka High Court on 31 August 2001 and superannuated on 19 October 2004. Some of the important milestones of his Judicial career as follows:

  • Nominated by Chief Justice of India as Member of Academic Council of National Law School of India, Bangalore from 1993 to 1996
  • Judge in the Madras High Court from 18 November 1997 till 21 January 1999.
  • Chief Justice of Madras High Court from 13 September 2000 till 30 August 2001
  • Chief Justice of Karnataka High Court from 31 August 2001 till 19 October 2004
  • Chairperson, Himachal Pradesh Human Rights Commission from 24 November 2004 till 15 July 2005
    Lokayukta, Himachal Pradesh till 15 July 2005
  • Chairperson of the Rajasthan State Human rights Commission from 16 July 2005 till 15 July 2010

Achievements

Rajasthan High court Bar Association

  • First Lifetime member and also served as the Joint secretary, General secretary, Vice President of the Association.
  • Initiated Bench Day celebrations on 31 December for re-establishment of High Court bench at Jaipur.
  • Chief Justice of India was invited in association function
  • Another supreme court judge was invited in library function

Bar Council of Rajasthan

  • Nominated as member of State Legal Services Authority.
  • Conducted workshops as member Bar Council of Rajasthan from 1971 to 1990 till elevated as Judge.
  • Member and Chairman of Enrollment committee.
  • Member and Chairman of Disciplinary committee.
  • Nominated as Chairman Rajasthan Hindi Vidhi Satarkta Samiti. Awards were distributed for the best Hindi written judgment by administrative and Judicial officials in the memory of former Chief Justice Vedpal Tyagi.

Bar Council of Rajasthan

  • Played important role in formation of Rajasthan State Advocate welfare act 1986.
  • Organised Silver Jublie celebration of the council where souvenir was published and released by then president of India Gyani Zail Singh
  • Advocates who have completed 50 Years of practice were honored by then Law minister Shri H. R Bharadwaj.
  • First C. L. Agrawal memorial lecture was conducted as convener which was organised by the Bar Council of Rajasthan.

Bar Council of India

  • Conducted several workshops, including workshop on Company law at Jaipur and moot court competition at Jodhpur.
  • As Member of Bar Council of India Trust.
  • Instrumental in sanctioning each association funds subsidiary for establishing and upgrading the libraries.

National Law School

As Member Governing Council motivated him to work for creating awareness of Legal Education and circulate them for the betterment of the Law practitioners and public .

Tamil Nadu State Legal Services Authority

As Executive Chairman Tamil Nadu State Legal Services Authority

  • Published and distributed substance and legal aspects of more than 14 acts and statues in their own regional Tamil language for the purpose of legal awareness to the public.

Chief Justice of Madras High Court

In all about 22 lack cases were decided by the subordinate judicial officers and about 2.8 lack cases were decided by the High Court till 20 August 2001. Prison adalat were constituted in various Jails where new lawyers were empaneled to attend legal aid and schemes of inmates.

First spell, from 22 January 1999 to May 1999 as Acting Chief Justice

  1. Inter-se seniority disputes between direct recruit and integrated Judicial Officers pending for more than a decade was resolved in single setting acknowledged by the Supreme court of India where seniority was fixed and promotions with the immediate effect.
  2. 294 posts were sanctioned in various categories in High Court Service in G.O.Ms No. 526, Home Department Dt: 21 April 1999.
  3. About 40,000 pending copy application for over 2 years in the Current Section were complied and brought up-to date.
  4. About 39,550 cases were disposed of in about 4 months, including 35 Full Bench matters.
  5. Sanctioned construction of an additional floor in the Annexed Building with parking in the administrative building by the Government order No. 1482 Home Department Dt: 10 November 1999.
  6. The Government sanction for computerization of the High Court in G.O.Ms No. 923 Home Department, Dt: 27 October 1999.
  7. Selection, training and posting of 73 Civil Judges (Junior Division) along with there promotions in the judicial services along with the High Court services.
  8. Construction of 286 Additional Law Chambers was sanctioned by the Government.
  9. As acting Chief justice, he had taken efforts to appoint 11 Additional Judges in permanent positions.
  10. Disposal of 42,760 cases where orders were instantly released in 38,940 cases.

Second Spell, from 28 September to 9 October 1999

  1. Resolved long pending issues of promotions to the officers and staff of the High Court.
  2. Important role played in establishing Madurai bench of Madras High Court resolving the pending demand for more than two decade.

Third Spell, as Acting Chief Justice from 6th June 2000 till 12 September 2009

  1. Separate Press Building was constructed to enabling in house publications of the documents subordinate court and the high court.
  2. Organized 2 week exhibition to mark the 50th year celebration of the Supreme Court of India which also showcased the chartered Madras high court since 1862.
  3. Prison court was held at Central Prison, Chennai where a Legal Aid Cell was also set up in the Prison Campus to mark Independence day celebration. Accordingly, similar prison courts were established at central prison of Madurai, Trichy, Vellore including special cell for women inmates. Two panel lawyers were deputed in legal cell to aid on all working days.
  4. As Executive Chairman of the Tamil Nadu Legal Services Authority, a Souvenir, first of its kind in this State, was published in Madurai.
  5. Nine Acts were translated and published in Tamil for Public to inculcate legal knowledge and legal awareness under legal aid program.
  6. Orientation program was arranged for 50 newly recruited Civil Judges (Junior Division) before there appoint in the court.
  7. Several Lok Adalats were held and the important one among them is the Lok Adalat held at Neyveli, wherein long pending Land Acquisition cases were settled and amount of Rs 20.81 crore were distributed as compensation on 11 March 2000.
  8. About 16 new Courts were inaugurated at various places in Tamil Nadu.
  9. Separate Pay & Accounts Office has been sanctioned by the Government exclusively for the High Court on its premises.
  10. Arrangement to supply the cause-list through the Internet as well as printed cause list were made available to the lawyers everyday in night itself.
  11. Court interim orders were made available on same day basis.
  12. 6 June 2000 to 31 August 2000 record number of 36,945 cases were disposed, including 52 Full Bench matters in respect of the copies of orders during the same period, out of 20,073 cases the order copies have been issued in 19,545 cases leaving only a negligible pending 528 cases.
  13. Acted as a chairman of the tribunal established under criminal law amendment act to assess anti social activities of Al Ummah during Coimbatore bast case.

Chief Justice of Karnataka High Court

  • A total number of 4532 Lok-Adalat sittings, where more than 1,00,000 cases were settled.
  • More than 109 crore of rupees were compensated in Motor Vehicle Accident and Land Acquisition cases.
  • Approximately 1842 legal literacy and legal aid campaigns were organized, where more than 6, 00,000 people have participated.
  • 8 Permanent districts civil courts were established.
  • 5 legal literacy booklets in Hindi, English and regional Kannada language were released on 9 November 2001.
  • Similarly on 16 January 2003, a book on legal information for everyone including 25 law topics was released, with an abridged edition of the booklet.
  • Eight audio Cassettes containing songs on legal literacy were released on 12 April 2003.
  • Disposal of about 2,38,000 cases as against the institution of 2.83 lack cases till 8 October 2004.
  • Sub-ordinate judiciary disposed about 25 lack cases since 2001 up to September 2004 under his supervision.
  • Questions of law referred to in 22 cases were decided by the larger Benches of 5 Judges. 259 cases, by the Full Benches of 3 judges.
  • Altogether about 22,587 cases were disposed by himself.
  • Establishment of 2 high court bench at Gulbarga and Dharwad.
  • Participated in 3rd Meeting of supreme court Chief Justice of the Judicial Group on Strengthening Judicial Integrity held at Colombo January 2003.

Rajasthan State Human rights Commission

  • Government officials NGO's and other similar institutions were regularly interacted with request to discharge there duties with loyalty and devotion on regular basis.
  • Around 106 individuals and institutes propagated and circulated Article 51(A) on recommendations.
  • Around 84 institutions have published and distributed thousands of copies of Human rights booklets.
  • Around 60 schools, colleges, NGO's etc. conducted multiple workshop for creating legal awareness among them.
  • Initiated Quarterly newsletters covering reports, orders and recent events.
  • List of incidents reported and addressed along with documentation of the cases reported in the previous year before his tenure begin.

President of the Management Committee Shri Mahavirji

He is a lifetime member of this working committee since January 1997 and contributes his efforts on regular basis. Under his presidency February 2011~14, he took the effort to publish an Introduction of the members of this committee since its inception in the year 1930, to highlight their contributions and motivate fellow members. He has broadly categorized his scope of work beyond the routine set of functions and activities which are regularly organised by the committee under the following heading.

Religious events and celebrations

  • A Stamp was released with pictorial view of the temple along with the seal on post card on 13th Rajpex 2012.
  • 10 gram silver coin of Lord Mahavira with temple premises on the other side was released in January 2012.
  • Successfully organised and conducted Nirvana Mahotsava where millions of pilgrims gather to participate in celebrating Lord Mahavira's Moksha (Jainism) day.
  • Gold work of the central peak (kalasha) of the temple was completed and dedicated on 27 March 2011.
  • Gold work of other 7 peak (kalasha) of the temple was completed and dedicated on 15 February 2012.
  • Gold work of remaining 17 peak (kalasha) of the temple was completed and dedicated on 11 July 2012.
  • Restoration and preservation work of all three Crown (Shikhar) was flawlessly continued under his supervision.

Education, research and publications

  • Facilitated educational visits of eminent international scholars. During his tenure students from renowned university of United States, Netherlands, Belgium, Australia etc. came to study multiple courses offered by Apbhransh Sahitya Academy in Prakrat and Apbhransha form of literature.
  • Millions of copies were published and distributed under several campaigns organised to promote Jain Darshan, Jainism and its concepts.
  • Diploma course got recognized by Vardhaman Mahaveer Open University and
  • Efforts under way to initiate Masters level degree course in Prakrat and Apbhransha form of literature in association with Vardhaman Mahaveer Open University
  • Obtain land from government on concessional rates for Apbhransh Sahitya Academy and Library a Malviya Nagar institutional area Jaipur.
  • Initiated quarterly news letter reflecting important events and activities organised under the committee management during his tenure.
  • A book was published with the brief introduction of the past and present members 100 in all since 1930 till December 2013.

Public health safety and community building

  • 12 Free medical camps were organised where more than 15,000 patients were treated for all kind health related issues.
  • Free tricycles and artificial limbs were distributed among the physically disabled at lucky mela.
  • Sewing machine were distributed to the widows at lucky mela.
  • Several new equipment including ECG, X-Ray, machines were dedicated to upgrade existing medical facilities.
  • New child care and Maternity center where Dr. Harsh Jain (Deputed by Govt.)and his team was acknowledged for treating 10,716, 1258 IPD along with 554 Delivery cases.
  • Vaidhya Shri Krishna kumar Sharma and his team was acknowledge for treating 1,00,8103 patients through Ayurveda at the locally setup Ayurvedic hospital which is managed and run by Shri Mahavirji management committee.
  • Dr. Jeevan lal Gandhi and his team was acknowledged for treating number of outdoor patients including 935 indoor patients at The Naturopahty yoga prakritik chikitsa center.

Development of infrastructure

  • New solar water heating plant was dedicated in October 2011.
  • Infrared CCTV cameras were installed within the temple premises and adjacent market in November 2011 ensuring better security coverage.
  • Started accepting online reservation booking through website on 19 December 2011.
  • Administrative infrastructure upgraded with addition of 8 new computers.
  • Automatic chapati making machine was dedicated in September 2012.
  • Lift was installed dedicated for physically disabled in October 2012.
  • 2 Additional D.G. Sets of 200 & 320 KVA were dedicated on 5 April 2012 to upgrade the electricity supply.
  • Automatic solar cooking and warming system was dedicated in February 2013.
  • Approximately 2100 meter underground drainage were laid for better sanitation.
  • Renovation of block No. 4 & 8 out of 48 halls along with up gradation of 12 dorms located at block 3.
  • 2 Additional buses were added to upgrade the existing fleet which commutes free trips between railway station and the main temple premises.
  • Construction of new building with approx 50 rooms was started and would be dedicated to the public shortly.

Recent activities

Though, Justice Jain had formally taken a retirement from most of the positions he held in multiple esteemed organisations but he is constantly contributing his efforts towards his ultimate goal of spreading Legal literacy & Legal awareness along with some social work. He is being regularly invited as an eminent speaker in various conferences, seminars and meetings.

Publications

Beyond rulings and judgments, Justice Jain have written, composed, and published a wide range of literature including, legal literacy awareness campaigns, articles, presentations, flyers & brochures, reports, Biopics etc. Some of his publications are still being used by various schools colleges universities NGO's as well as individuals and government organizations as his contributions and achievements to educate and motivate the society. He have written and composed 32 booklets and more than 70 presentations were prepared under his guidance by students of various Law colleges and universities. He has also motivated more than 80 organisations ranging from individuals to professionals, Schools to Universities including several Government and Non Government organisations to spread the legal awareness through there regular programs and publications.
